1. General

1.1. These Terms govern use of the website at effingtop.com (the "Service").

1.2. The Service is owned and operated by DAW.IT – Dawid Witulski, ul. Grottgera 13A/9, 64-920 Piła, Poland, VAT ID: PL7642697963 (the "Operator").

1.4. Using the Service means you accept these Terms.

2. Definitions

3. What the Service does

3.1. The Service provides a paid ranking of websites and profiles. Order is set purely by the sum of Payments tied to an Entry — a higher sum ranks higher.

3.2. To create or raise an Entry, a User submits a URL/profile, picks a category (for a new Entry), and completes a Payment through the Payment processor.

3.3. No account is required. An Entry's identity is its normalized URL or profile name.

3.4. This is a digital service: once a Payment is confirmed, the Entry is created or updated immediately and its total increases by the Payment amount.

4. Ranking rules

4.1. Position is set by the sum of all confirmed Payments ("all-time" ranking). The Service also offers a daily ranking (UTC).

4.2. Ties are broken in favor of the Entry with the earlier first Payment.

4.3. The Operator does not guarantee any position will be maintained — it can change at any time as other Users pay.

4.4. The minimum Payment is $5, and every Payment must be a whole dollar amount. Amounts are in US dollars.

5. Payments

5.1. Payments are handled by Dodo Payments, which acts as the Merchant of Record: Dodo is the seller on your statement, collects your billing details, and handles applicable sales tax/VAT. The Operator never sees or stores card details.

5.2. A Payment is non-refundable. The service (creating/raising an Entry) is performed immediately upon confirmation — see Section 7.

5.3. The Entry is updated once the Payment is confirmed by Dodo Payments. If a Payment is refunded or charged back, the corresponding amount is deducted from the Entry's total.

6. Content and the Operator's rights

6.1. You confirm you're entitled to submit the given URL/profile and that it doesn't violate any law or third-party rights.

6.2. Links to chat/invite services (including t.me, wa.me, discord.gg, chat.whatsapp) and unlawful content — including content that infringes personal rights, copyright, or contains malware — are not allowed.

6.3. The Operator may hide or remove an Entry that violates the law, these Terms, or the Service's reputation, and may refund Payments tied to a removed Entry where warranted.

7. Withdrawal / cancellation rights

[LEGAL REVIEW NEEDED] Consumer withdrawal rights for digital services vary materially by country — for example, EU/UK consumers generally have a statutory right to cancel a distance contract within 14 days unless they've expressly requested immediate performance and acknowledged losing that right once the digital service is fully performed; the US generally imposes no equivalent statutory cooling-off period. This section needs a real jurisdiction-by-jurisdiction answer (and matching checkout copy) before launch, rather than the placeholder assumption below.

7.1. (Placeholder, pending review) By making a Payment, you request immediate performance of this digital service and acknowledge that your right to cancel, where one applies under your local law, ends once the service (creating/raising your Entry) has been fully performed.

8. Complaints

8.1. Complaints about the Service, payments, or Entries can be sent to [email protected].

8.2. Please include: a description of the issue, what you're asking for, and enough detail to identify the Payment (date, amount, the URL/profile submitted, and the transaction id if you have it).

8.3. The Operator aims to respond within 14 days of receiving a complaint.

8.4. A complaint about the payment itself (e.g. a charge or refund) can also be raised directly with Dodo Payments, under its own terms.

9. Liability

9.1. The Service only provides the ranking mechanism and isn't responsible for the content of any submitted site or profile.

9.2. The Operator works to keep the Service running but doesn't guarantee uninterrupted, error-free availability and reserves the right to technical downtime.

10. Personal data

Data handling is described in the Privacy Policy.

11. Changes to these Terms

11.1. The Operator may update these Terms for valid reasons (legal changes, changes to the Service). The updated Terms are published on the Service with their update date.

11.2. Payments made before a change takes effect are governed by the Terms in force at the time of that Payment.

12. Final provisions

[LEGAL REVIEW NEEDED] Governing law and dispute resolution for a global, English-language service haven't been decided yet — this needs a deliberate choice (and disclosure to users), not a default carried over from the Polish site.
